Terms of Service

1. Acceptance of Terms
By accessing or using Federal Funding Intelligence ("the Service," "we," "us," or "our"), you ("User" or "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not access or use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Description of Service
Federal Funding Intelligence provides a searchable database of congressional earmark data, including House Community Project Funding (CPF) and Senate Congressionally Directed Spending (CDS) requests and awards covering fiscal years FY2022 through FY2026 (range updated as new data becomes available). The Service aggregates, organizes, and presents publicly available data sourced from the House and Senate Appropriations Committees, GovInfo.gov, USASpending.gov, and other government sources. We do not create, originate, or independently verify the underlying government data.
3. Subscription and Payment
Access to certain features requires a paid subscription. By subscribing you agree to:
- Pay the applicable subscription fees as described on our pricing page
- Provide accurate and complete billing information
- Authorize recurring charges to your payment method until you cancel
- Notify us promptly of any changes to your billing information
Founding Member pricing is locked at the rate in effect at the time of subscription for as long as the subscription remains active and in good standing. We reserve the right to change pricing for new subscribers at any time.
4. Cancellation and Refunds
You may cancel your subscription at any time from your account settings. Monthly subscriptions will not be refunded for the current billing period. Annual subscriptions are non-refundable after 30 days from the date of purchase. We reserve the right to issue refunds at our sole discretion in exceptional circumstances.
5. Acceptable Use
You agree not to:
- Use automated tools, bots, scrapers, or crawlers to bulk download data from the Service
- Resell, sublicense, or redistribute data obtained from the Service without our prior written permission
- Use the Service to build a competing product or service
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
- Attempt to circumvent, disable, or interfere with any access controls, rate limits, or security features
- Share your account credentials with others or allow unauthorized access to your account
- Misrepresent data obtained from the Service or present it in a misleading context
- Engage in any activity that places an unreasonable load on our infrastructure
We reserve the right to monitor usage for compliance with these Terms and to enforce usage limits.
6. Data Accuracy and Limitations
The data provided through the Service is sourced from publicly available government documents and third-party databases. While we make reasonable efforts to ensure accuracy, completeness, and currency of the data, you acknowledge that:
- Government source data may contain errors, omissions, or delays that are beyond our control
- Earmark status, award amounts, and recipient information may change after our last update
- Our data processing, normalization, and classification may introduce errors
- Coverage is not guaranteed to be exhaustive for any fiscal year or chamber
You are solely responsible for verifying critical information with primary government sources before making any decisions based on data obtained from the Service.
7. Disclaimer of Warranties
Important — please read carefully
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. FEDERAL FUNDING INTELLIGENCE EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION:
- ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT
- ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS
- ANY WARRANTY AS TO THE ACCURACY, COMPLETENESS, TIMELINESS, OR RELIABILITY OF ANY DATA OR CONTENT PROVIDED THROUGH THE SERVICE
- ANY WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU IN FULL.
8. Not Professional Advice
The data, analysis, scores, classifications, and other content provided through the Service are for informational purposes only. Nothing in the Service constitutes legal advice, financial advice, investment advice, procurement advice, lobbying strategy, or any other form of professional advice. Federal Funding Intelligence is not a law firm, financial advisor, or registered investment advisor.
You should not rely solely on data or analysis from the Service when making procurement bids, grant applications, lobbying decisions, investment decisions, or any other consequential business or legal decisions. You are solely responsible for evaluating the appropriateness of any information for your specific situation and for obtaining independent professional advice where appropriate.
9. Intellectual Property
The Service, including its organization, structure, search algorithms, scoring models, classifications, user interface, and presentation of data, is the intellectual property of Federal Funding Intelligence and is protected by applicable copyright, trade secret, and other laws. The underlying government data is in the public domain. You may not reproduce, copy, modify, distribute, or create derivative works from our compiled database or proprietary features without our prior written permission. Limited exports permitted under your subscription tier are for your internal business use only.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FEDERAL FUNDING INTELLIGENCE, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY:
- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES
- LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, OR ANTICIPATED SAVINGS
- DAMAGES ARISING FROM RELIANCE ON INACCURATE, INCOMPLETE, OR OUTDATED DATA
- DAMAGES ARISING FROM DECISIONS MADE BASED ON CONTENT FROM THE SERVICE
- COST OF PROCUREMENT OF SUBSTITUTE SERVICES
EVEN IF FEDERAL FUNDING INTELLIGENCE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE).
IN ALL CASES, OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU TO FEDERAL FUNDING INTELLIGENCE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
11. Indemnification
You agree to defend, indemnify, and hold harmless Federal Funding Intelligence and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) your misuse or misrepresentation of data obtained from the Service; or (e) any claim by a third party arising from your use of the Service.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including but not limited to: violation of these Terms, suspected fraudulent or abusive activity, non-payment, or at our sole discretion. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination — including Sections 7, 8, 9, 10, 11, 14, and 15 — shall survive.
You may terminate your account at any time by canceling your subscription and ceasing use of the Service.
13. Third-Party Services
The Service relies on third-party providers including payment processors, database infrastructure, and authentication services. These providers have their own terms of service and privacy policies. Federal Funding Intelligence is not responsible for the availability, accuracy, or conduct of any third-party service, and your use of third-party services is at your own risk. Links or references to third-party websites or resources do not constitute an endorsement.
14. Changes to Terms
We reserve the right to modify these Terms at any time. For material changes, we will provide at least 14 days' notice by email to your registered address before the changes take effect. Non-material changes (such as corrections or clarifications) may take effect immediately upon posting. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and cancel your subscription.
15. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally shall be submitted to binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, with proceedings conducted in Dallas County, Texas. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm. YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS OR REPRESENTATIVE ACTION.
16. General Provisions
Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Federal Funding Intelligence regarding the Service and supersede all prior agreements and understandings.
Severability. If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
No Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
Assignment. You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
